Has Canon Got a Large Digicam Class Action Lawsuit on Their Hands?
The subject of product design defects is an interesting one. Should manufacturer be held liable for any and all repairs to a product once it has been sold to customers and a widespread issue has been discovered? If the defect is trivial, and has tiny influence on the operation of the product should they continue to be compelled to repair it? Who decides if a fault is indeed ‘minor ‘ and how if the whole process best be handled?
There are a few examples today of consumer digicams that have well-known defects, but the manufacturers’ employees when asked questions about the difficulty will state they have never heard about it before. All of the major camera makers are guilty of this, so it looks to be the policy of each company to reject awareness of a difficulty unless compelled to do so legally.
When a large issue appears with a product, and the manufacturer knows the difficulty, they should fix it. That does sound right. For instance, it is reported that the Ford Motor Company decided it would be cheaper in the longer term to NOT recall the “Pinto” model cars that had a hefty rate of catching on fire and exploding when in certain accidents due to poor design. Instead of fixing the difficulty before there was an accident, they made a decision it would be cheaper to settle lawsuits against them for wounds and deaths due to the design instead. Clearly in this situation, the manufacturer should have fixed the car before there had been any injury or deaths in the 1st place.
When it comes to smaller electronics, when is it worth it to take the company to court and attempt to cause them to fix the product? As an example, the Canon SD790 side screws always vibrate themselves loose and drop out of the camera. This will cause the side trim of the camera body including the handstrap itself to fall off, leaving a giant gaping hole in the side of the camera for dust and waste to enter easily.
The screws should be held in place with something such as “Locktite”, and can be purchased online for about $7 including shipping for a pair. In this situation should the manufacturer pay each consumer of this camera $7 or send them a pair of screws and some “Locktite” to secure them? We both know that the only real way that would happen is if they were legally compelled to do so. The difficulty is, a legal case will take forever to settle, and the sole folks who actually benefit from it are the counsels, and no-one else.
A lawyer in a case like this, representing tens of thousands of buyerss, could stand to earn a hundred thousand dollars or even more for his or her time, while the consumer sees just $7 each. Is this fair? Is this justice? The case could take a long time to settle, and in the meantime all you would like is a screw repair kit for your Canon SD790!
A new defect that is starting to be seen is that the Canon G9 digital camera also has screws that work themselves loose and fall out over time! Now there are thousands of customers looking for Canon G9 screws as well! Is there no end in site?
Indeed the honorable thing for the maker to do would be to own up to the difficulty and provide a solution for either an exceedingly nominal cost to the customer or no charge . This may go a ways to extend consumer confidence in the maker as well as keeping that shopper trustworthy to the brand so making the cash back through future purchase. Sadly it seems like established companies might be too concerned about today to contemplate the future.
